That's the thing, Apple has been courting the idea that the watch is a device that can help in the diagnosing of issues without actually calling it a medical device... While doing things like poaching engineers from Masimo, whom makes medical devices.
And there's a reason for that because the medical device goes through some pretty intense scrutiny, because it has to do what it says on the box. There was only so long that Apple could keep up the charade of the non-medical device, and clearly Masimo is not about to take that lying down.
Smartwatches have always been just another way to mine information from the useful idiots stupid enough to purchase and wear them constantly. Marry it up to a phone and absorb a person into whatever ecosystem of devices they live in and you've got one more conduit to milk the wearer as a product. While I acknowledge the patent infringement problem, I really think nothing should be done to protect consumers that are too outrageously dumb to bother caring for themselves in the US by demanding EU-like protections from their instruments of governance. It's naturally self-cordoned by oceans so let the entire mess consume itself in its own festering ignorance.
EU govt is not the savior. It will never work for the EU Citizens it works for the highest bidder or the most powerful banker. The Smart-era is already metastasized into an uncontrollable tumor at this point.
Fingerprint data is one, Apple says they do store it on the device, but nope. Nobody knows what sepOS does its all closed source only a few bits of information exists on the internet due to some security vulnerabilities, look at the branch prediction vulnerabilities we see on the CPUs. Apple already has entire world's Facial math data esp the iSheep. Others like Samsung and other Chinese OEMs also are putting their so called NPU/AI ARM blocks on their SoCs to data mine.
Owner is not the controller anymore they are merely a battery like in the Matrix to generate money.
I like analog watches, ARM in a watch is like inviting spyware through your front gate.
I wonder what would happen if the concept of money were erased for a while. Everything these corporations do, under the big, smiling banner of caring for us, is simply to line their bank accounts. Even this current push towards AI, what is it but a desperate dash for dollars?
AI was the fashionable subject of 2023. Last year, it was cloud computing, and XYZ-as-a-Service. What will 2024's darling child be, I wonder?

Masimo are no saints either, but this sounds like Apple arguing that they should be allowed to steal because they are profitable. How that hasn't led to them being severely punished... well...
It's a terrible precedent to set. The only upside is that one day it might happen to Apple themselves.
In a couple of years Masimo may be bought off by Apple or poached off. Or Broadcom type takeover by some mega corporation. This is how the most vile and cancerous corporation rolls.
GTAdvanced, PowerVR, Qualcomm (escaped) felt the wrath, there are a lot more that did not even surface.
